TOWN OF EDGECOMB MINUTES OF THE COMMITTEE TO DRAFT ORDINANCE REVISIONS

The meeting was called to order at 6:15 P. M.
Stuart Smith reported he had asked Attorney Erik Stumpfel to review the proposed wording of Section 4.8 of the Building Code and to recommend wording that would protect projects with water and sewer within the TIF district from density restrictions of the section as well as projects outside the Gateway District. Erik is on vacation and Eaton Peabody responded in Erik's absence.
The term "Multiple Residential Units" was discussed. "Residential" is defined and is synonymous with "Dwelling." There are definitions for the three categories of dwelling units: single-family dwelling, duplex dwelling and multi-family dwelling. There is no definition for "Multiple Residential Unit" so Katharine contended that the dictionary definition would be used. Sue Carlson recommended that the heading be changed to "Lot Size for Multi-family Residential Units. There was disagreement over what the original intent of the ordinance was, i.e. multiple units in one building, or multiple separate units. Stuart said the ordinance was originally drafted to accommodate a proposed development, with water and sewer, of apartments and houses and the intent was to cover both multi- family and individual units.
The final version approved by the committee is:
"4.8 Lot Size for Multiple Residential Units
For any residential unit above one, with the exception of an accessory apartment, the lot must contain one additional acre per unit in addition to the minimum lot size required for that particular district. For any residential unit above one, with the exception of an accessory apartment, in the Gateway District, Thoroughfare District, Commercial Growth District or within a Tax Financing District adopted by the Town of Edgecomb, and not in Shoreland, on a lot having public sewer and water, the lot must contain an additional one-fourth acre per unit. Residential structures must be separated by a minimum of thirty (30) feet."
There will be five articles on the warrant for September 20. The first is election of a moderator. The second is the citizen-initiated petition to reword Section 4.8 and the third, also a citizen- initiated petition is to make the second article, if it passes, retroactive to June. The fourth article is the committee's recommendation and the fifth is approval of funds to hire a part-time town planner. The third article will not be voted on if the second article is defeated. A public hearing will be held on September 6.
The definitions of "Lot" and "Lot of Record" were discussed with a view to eliminating "Lot," but it was decided to make no change at this time.
