MINUTES, OCTOBER 7, 2010

 

PUBLIC HEARING

 

Gregory Sprague, Site Plan Review application for home occupation, Map U-16, Lot 2

 

The chairman opened the public hearing at 6:30 p.m.  Gregory Sprague said he was apply for approval for a home occupation for his automobile repair business at 734 Boothbay Road.  He was asked to provide the receipts for certified letters sent to abutters.  There were no other comments or questions.  The public hearing closed at 6:34 p.m.

 

REGULAR MEETING

 

1.  Call to Order

 

The chairman called the meeting to order at 6:34 p.m.

 

2.  Roll Call

 

Members present were Vice Chairman David Boucher, Chairman Jack French, Barry Hathorne, Pat Jeremiah, who arrived during the meeting, and Jarryl Larson and alternates David Nutt and Amber Tonry.  David Nutt was appointed to act for Jeremiah until her arrival.

 

3.  Approval of September 30, 2010 minutes

 

David Boucher moved to approve the minutes as presented.  Vote 4-0-1.

 

4.  Gregory Sprague - Site Plan Review application for home occupation, Map U-16, Lot 2

 

Sprague was asked to note on the plan the 22-foot distance of the sign from the front lot line and the five-foot distance from the driveway.  David Boucher moved to approve the site plan review application of Gregory Sprague.  Vote 5-0-0.  The $200 fee was paid.

 

5.  Robert Burns - Resource-based subdivision pre-application, Map R-1, Lot 21

 

Burns presented his application for a resource-based subdivision for property that he has under contract.  He stated for the record that this was a functional division of five units because the units existed before zoning.  He plans to reduce that into four lots, all 2.5 acres or greater.  Four or five acres are in the Resource Protection district and are part of the 10 acres that will be owned in common and devoted to tree growth and forest management. 

 

The access will not be changed.  Several abutters have easements through the property and will become members of the road association and share in maintenance costs.  Burns will submit a letter from the engineer regarding the Frye access to the road, indicating that after expanding the road thirty feet, safety concerns will be eliminated.  Jarryl Larson said that a turnaround for emergency vehicles would be necessary. 

 

The farmhouse on the property will probably be torn down, the barn is in good condition and the cottages are salvageable, but an owner may prefer to demolish and build a single-family house.  There will be more than two acres per residential unit. 

 

The wetlands study and soils report were submitted. 

 

A site visit will be held on October 23 at 9 a.m. 

 

6.  Nicholas Dinatale - Building permit application in shoreland, 22 Shore Road, Map R-3, Lot p/o 40

 

Robert Burns presented this application for Mr. Dinatale for a single-family house on 2.37 acres in the Limited Residential District, 86 feet from the shore.  Erosion and sedimentation control details are shown on the plan.  Mr. Burns will submit a letter of authorization to represent Dinatale and written responses to the findings of fact at the November 4 meeting.  Barry Hathorne moved to find the application complete with the exception of the authorization letter and responses.  Vote 5-0-0.  David Boucher moved that Barry Hathorne and Jarryl Larson meet Burns for a visit to this property after the site walk scheduled on October 23 for the Sunset Vista property.  Vote 5-0-0.

 

7.  Other Business

 

The Appeals Board ordinance will be discussed at the next meeting following the board’s review of the state statutes, Title 30A, Sections 2691 and 4353.

 

David Nutt advised that according to the Blasting Ordinance application, blasting of more than 100 cu. ft. must be approved by the planning board and that the board had not approved the blasting taking place on the Rioux property.  He said that Helen Weld was concerned that the blasting would affect her well.  Jack French said the person doing the blasting had to make application to the selectmen and would be responsible for any damage.  David Boucher said that the subdivision approval included an approval of construction of the road, including topos existing and proposed.  The planning board could not know at that time how much material would be blasted.  David Nutt said it was imperative that monitoring take place on the Salt Cove project.  Jack French reported that the town’s engineer was monitoring the project and suggested that Nutt could call the CEO and report this potential violation. 

 

8.  Adjournment

 

Barry Hathorne moved to adjourn at 7:45 p.m.  Vote 5-0-0
