EDGECOMB PLANNING BOARD MEETING MINUTES
August 18, 2005
The meeting was called to order by Chairman Stuart Smith at 6:35 p.m. Board members present were Dave Boucher, Bruce Cameron, Erin Cooperrider, Amanda Russell and Stuart Smith and Alternates Katharine Braid and Lisa McSwain.
Amanda Russell moved, Bruce Cameron seconded, to accept the August 1, 2005 minutes. The motion carried.
The Frasers plan to rebuild a boathouse in the Damariscotta River. The building is rotten and cannot be repaired. A memo from DEP stated that the boathouse and ramp could be rebuilt using the same footprint and if the use was not being changed, the applicant could apply for a full NRPA permit. It added that erosion control devices must be implemented during construction. The application was reviewed and Lisa McSwain moved, Erin Cooperrider seconded, to accept the application as complete. The motion carried. It was determined that a site walk was not necessary
Maintenance versus reconstruction was discussed. The Frasers plan to demolish the current building. The proposed building will not be more non-conforming and will be slightly smaller than the original boathouse. Under the ordinance, reconstruction or replacement of non- conforming buildings damaged or destroyed by more than 50% of their market value is allowed. It was the consensus that the proposed work contemplated by the Frasers was not caused by a single event and that the reconstruction constituted more than maintenance. Although the reconstruction of a dilapidated boathouse was not specifically allowed by the ordinance, Stuart Smith said he thought it conformed to the spirit of the ordinance. Dave Boucher moved, Bruce Cameron seconded, to approve the project. The motion carried. The Board made positive findings that the proposed use:
Erin Cooperrider moved, Amanda Russell seconded, to amend the approval conditional upon obtaining an NRPA permit and that erosion and sedimentation control measures be put in place. The amendment carried. The $351 fee was paid
The Ellinwoods plan to build a 36' x 90' farmhouse on Fort Road. The application was reviewed and Lisa McSwain moved, Erin Cooperrider seconded, to accept the application as complete. The motion carried. It was determined that this lot was not part of a subdivision. The Board made a positive finding that the proposed use:
Lisa McSwain moved, Erin Cooperrider seconded, that the Board approve the Ellinwood's application for a farmhouse on Fort Road with the condition that the applicants provide a deed creating a conforming lot. The motion carried. The $1,057 fee was paid.
Erin Cooperrider asked that the landscaping for the buildings that are within 75 feet of the water includes revegetating a buffer for erosion control. Mr. Bintliff will submit a comprehensive landscape plan, a sample of which is around the first remodeled unit. Katharine Braid suggested that it would be beneficial to have a good idea of the various stages and in what order they will be presented to the Board, as approval of an early stage may affect what can be done in the later phases.
A workshop session with Mr. Bintliff will be held on September 7 at which time a complete package will be presented to the Board for discussion including location of all proposed units and a resolution of the footprint issues. The applicant was advised that minor revisions in the plan can be made later without submitting a complete second application. Density in Shoreland will also be addressed with David Soule, Town Attorney; Bob Faunce, County Planner; and Rich Baker, DEP, who will be asked to attend. If the application is complete, it will be considered at the September 15th meeting.
Erin Cooperrider asked the Board to consider that this development is in the General Development District and will have water and sewer. Inasmuch as water and sewer may be extended to other properties in the General Development District, the decisions made for this application will be precedent-setting. Moreover, it should be kept in mind that water and sewer might be extended down Route 27 to the school. She asked the Board to review the ordinances dealing with density of the Maritime zone, the Shoreland overlay restrictions, the historic interpretation of residential lot size in Shoreland of two acres on which can be built a house and an accessory building, and the correspondence on this matter which had been forwarded to the Board. The Sheepscot property consists of six+ acres in Shoreland and three outside the 250-foot boundary. There are currently 16 dwelling units on the property and four commercial units. Change of ownership structure has been approved. At the workshop meeting, it will be necessary to determine if the16 units can be moved to other locations in Shoreland and if increased density will be allowed.
Erin Cooperrider reported on a meeting with Bob Faunce on the Land Use Ordinance. His comments were later summarized in a memo that has been emailed to the Board. He referenced the Waldoboro ordinances on which he has worked, and copies of these have also been sent to the Board. Amanda Russell will send Erin a copy of David Soule's recommended changes to the ordinances.
