EDGECOMB PLANNING BOARD MEETING MINUTES
March 7, 2005
The meeting was called to order by Erin Cooperrider, Chair, at 6:35 p.m. Board members present were Bruce Cameron, Erin Cooperrider, Lisa McSwain, Amanda Russell, Stuart Smith and alternates Brian Bolduc and Dave Boucher.
Amanda Russell moved, Stuart Smith seconded, to approve the minutes. The motion carried.
Erin Cooperrider said that it was her recollection that in amending the Building Code the previous year, it was the intention of the Board to not increase the density in Shoreland. Town Attorney David Soule, who had originally opined that the higher density (two acres for the first unit and one-quarter acre for each additional unit) with town water and sewer was allowed in Shoreland under the Building Code, was asked to look at the intent of the amended ordinance. He said that he had originally looked at the Building Code as an overlay district to accommodate development in the town. However, he said that the Shoreland Ordinance states that the more restrictive zoning (Shoreland Ordinance requires two acres per dwelling unit) would prevail and taking that into consideration as well as the public sentiment at the public hearing and the Planning Board's intent, there was an argument for the Shoreland requirement of two acres for the first as well as each additional unit.
In response to Lisa McSwain's question regarding the effect of this interpretation on the plans of Edgecomb Development, LLC, Erin Cooperrider said that no specific proposal had been made and the developer had asked for an interpretation of the ordinances regarding the allowed density in Shoreland. Amanda Russell said that MMA had interpreted Edgecomb's ordinances as not allowing increased density in Shoreland. She added that the matter had been discussed for the past two years and it was the intent of the voters that the density in Shoreland not be increased. It was the consensus of the Board that the interpretation of the ordinances did not support increased density in Shoreland
Erin Cooperrider will communicate the Board's interpretation of the ordinance to Jeff Corbin and Attorney Doug Britton, i.e. that the increased density calculation does not apply to the 250 feet from the mean high water mark which is Shoreland.
Building Code: The changes were pointed out, i.e. the consolidation and change of the buffer section to the Standards and clarification of the Planning Board's role.
Definitions: "Impervious surface" was discussed, specifically whether mown lawns should be classified as an impervious surface. Amanda Russell said that according to NEMO (Non-point Source Pollution Education for Municipal Officers) mown lawns are impervious. It was decided to use the most restrictive definition in that evening's discussion of the ordinance changes at the public meeting, although more research will be done.
The meeting recessed at 7:00 for the Public Meeting and resumed at 7:40 p.m.
Erin Cooperrider reported a response from Dabney Lewis regarding the possible impact of construction on a cranberry bog. He said that the bog was not a wetland and that the building will be 75 feet from the edge of the swamp. The land is currently under contract.
There were no comments or suggestions on the budget and report for the Town's Annual Report.
