EDGECOMB PLANNING BOARD MEETING MINUTES

October 4, 2004

The meeting was called to order by Erin Cooperrider, chair, at 6:35 p.m. Board members present were Bruce Cameron, Erin Cooperrider, Lisa McSwain, Amanda Russell and Stuart Smith and Alternates Brian Bolduc and Dave Boucher

  1. Review Minutes of September 16, 2004:

    Stuart Smith moved, Amanda Russell seconded, to accept the minutes with the addition of “or the height of the building whichever is greater” after “the buildings must be 30 feet apart” in the Grace Goldberg co-housing discussion. The motion with the addition carried. It was pointed out that the DEP approved a permit for a dock, ramp and float for Mr. Friedland that was smaller than that in the application approved by the Planning Board. The Code Enforcement Officer had issued a building permit for the smaller structure

  2. Discussion of Ordinance Compilation:

    It was decided to remove definitions from the Mobile Home Ordinance and the Flood Plain Ordinance and add them to the Definitions section. The following definitions were changed or will be researched as noted:

    • Basement: The enclosed area underneath a structure, typically having its floor subgrade, and walls that comprise the structure’s foundation. The clear height up to the joists supporting the floor direction above is three (3) feet or greater.
    • Building (in definitions section): Deleted -- add “See Structure”
    • Code Enforcement Officer: A person, appointed by the Municipal Officers, responsible for performing the inspection, licensing and enforcement duties required by a particular statute or ordinance.
    • Flood Plain: Erin will check FEMA definition.
    • Functionally Dependent Use (in Flood Plain Ordinance) Delete and add “See Functionally Water-Dependent Uses”
    • Manufactured Housing Unit, Mobile Home, etc: Discussion postponed -- Erin and Lisa will work on this.
    • Structure (in Flood Plain Ordinance): Delete
    • Structure (in definitions section): Anything built for the support, shelter or enclosure of persons, animals, goods or property of any kind, together with anything constructed or erected with a fixed location on or in the ground, exclusive of fences. The term includes structures temporarily or permanently located, such as decks and satellite dishes for other than private use. A gas or liquid storage tank that is principally above ground is also a structure.
    • Variance (in Flood Plan Ordinance): Delete

    In the Shoreland Ordinance “service drops as defined” appears in Section 14. This is not defined. Erin will research a definition for service drops.

    Abutter notification by applicant will be added to the Site Plan Review Ordinance, Shoreland Ordinance and the Mobile Home Park Ordinance.

    Where the Site Plan Review ordinance lists sight distances required for various posted speed limits, a sentence will be added to indicate that MDOT requirements will supercede those in the ordinance.

    Calculating fees for Site Plan Review plus Building Permit (Note: I checked and I was wrong -- Bob always did it.)

    A separate fee schedule will be developed. (Note: Should the fees be removed from the ordinances with a note to see Fee Schedule?)

    The Mobile Home Park ordinance refers to Maine DOT standards for roads if the developer intends to dedicate them to the public. These will be researched by Erin.

    In Section 14 of the Shoreland Ordinance the words “except for timber harvesting” will be deleted after Forest Management Activities.

  3. Subdivision Review and Check List:

    Stuart Smith will draft a check list for discussion at the November meeting.

  4. Posting of Meeting Minutes:

    Bruce Cameron asked whether appendices to the minutes should be included with the minutes on the website. It was the consensus that as a matter of course letters, memos and other materials not be put on the website with the minutes; however, a decision may be made at any meeting that material should be appended to the minutes.

  5. Complaints:

    There had been two phone calls expressing concern that Grace Goldberg’s co-housing would be developed as a resource-based subdivision. The callers had been advised that the application would be for a regular subdivision.

  6. Other Business:

    Brian Bolduc reported that the DEP is requiring Willis Clifford to rebuild his front wall on the water at the Eddy Marina. He asked whether Mr. Clifford would need a permit if he just pulled the gravel back, fixed the wall and replaced the gravel. Mr. Clifford will be advised to contact the Code Enforcement Officer.

    Erin Cooperrider had received a query from Sigrid Associates regarding the building of a second structure on 2.5 acres on the Damariscotta River. It was the consensus of the Board that the Shoreland Ordinance requires all dimensional requirements be met for each additional dwelling on the property, so four acres would be required.

    Bruce Cameron said that the TIF would not be on the ballot on November 2nd as the deadline for sending out absentee ballots had not been met.

Stuart Smith moved, Lisa McSwain seconded, to adjourn the meeting at 8:10 p.m.
